Petition for Harsher
Punishment for Child Abuse
in Kentucky- Elena Law
- Kentucky recently passed a law, “Kimber’s Law”,
which allows the Commonwealth to seek the death
penalty for intentional murder of a child under age
12.
- Kentucky’s current laws divide child abuse into 3
separate offenses: 1st degree charge of child abuse
is a class C felony with a penalty of 5-10 years
with a fine of $1,000-$10,000; 2nd degree charge is
a class D felony with a penalty of 1-5 years and a
fine of $1,000-$10,000; 3rd degree is a class A
MISDEMEANOR with a sentence of no more than
12 months in jail and a $500 fine.
- In 2021, the US Department of Health and Human
Services Children’s Bureau found that Kentucky’s
child abuse victim rate was about 15 per 1,000
children, almost all being children ages 1 and
under. Kentucky’s child abuse victim rate is
TWICE as high as the whole United States child
abuse victim rates of 8.1%. Just in 2021, there were
14,963 reported child abuse victims.
- Elena was under the age of 2, only 17 months old,
when she was brutally sexually abused, physically
abused, and tortured, ultimately resulting in her
death.
- These offenders are usually released from prison
within 5-10 years or given a plea deal and more
than likely commit the act again to either the same
child, or different children, ultimately resulting in
more child abuse victims and deaths. Statistics
show that 5.1% of child molesters and abusers
were rearrested for a NEW sex crime within 3
years of their release.
- This is why we are forming a petition for an ‘Elena
Law’, which will seek harsher punishments,
including the death penalty, for monsters like these
who hurt innocent, defenseless children.
