It doesn't matter, the path does not exist. People cross here, since it's a shortcut, but there's no crossing. Basically a https://en.wikipedia.org/wiki/Desire_path
I agree in that the path is illegal, but it *does* exist. You can clearly see it on aerial imagery and also on the ground. I've even used it myself (don't tell the cops, please).
So, I think it should stay on the map. We could add access=no if you like.
Indeed, you are both correct that there is a de facto crossing (there is even a gap in the hedge), but that it is signed as illegal. Therefore, I added `crossing=no` and `access=no` on the path as suggested in access=no
I did the same with the two crossings just east from here.
As for the height limit, Street Complete asks for it as apparently:
> maxheight=* - if a max height is signed (sometimes present when the railway is electrified via wires situated overhead, above the tracks)
This is irrelevant in this case.
