Woman fined RM10,000 for infanticide, court prioritises rehabilitation over punishment

A woman, who was charged with throwing her newborn baby from an apartment five years ago, was fined RM10,000 by the Penang High Court Friday (Aug 8).   Judge Rofiah Mohamad, who delivered the verdict, said that the accused M. Santhiea's interests and mental health, who was 18 at the time, took precedence over public interest in the case. 00:00The Penang High Court on Friday fined a woman 10,000 ringgit for throwing her newborn out of

00:10the window of her apartment building five years ago. 23-year-old M. Santhia had served three

00:16months in jail between July 10, 2020 and January 15, 2021. In delivering her verdict, Judge Rofia

00:25Mohamed said Santhia's interests and mental health, who was 18 at the time, took precedence

00:31over public interest in the case. She added that the court took into consideration the social report

00:37submitted by the Welfare Department. While the crime for committing infanticide is punishable

00:42by up to 20 years in prison and a fine upon conviction, Judge Rofia said Santhia suffers

00:49from major depressive disorder and manic stress. The incident, she said, happened when the accused

00:55was in a panic state, hence it was a spontaneous reaction and an unconscious decision.

01:01The judge also noted that Santhia has been haunted by the incident, continues to receive psychiatric

01:07treatment and that her family has faced social ostracism. Judge Rofia stressed that the sentence

01:13should be rehabilitative rather than punitive and acknowledged the time Santhia had already

01:18served in jail. In default of the fine, the accused faces five months in jail. Santhia was

01:24represented by RSN Raya while Deputy Public Prosecutor Nurul Khairiya Dahalan prosecuted.
