Prohibited Product & Ilegal Use and Suspicious Activities

This prohibited product is subject to Malaysia law or by other payment service provider (e.g Banks, PAYNET and MPGS) such as:

  2. Direct Marketing – Outbound Telemarketing Merchants
  3. Outbound telemarketers
  4. Direct Marketing – Continuity / Subscription Merchants
  5. Direct Marketing – Other Direct Marketers – not elsewhere classified
  6. Direct Marketing – Inbound Telemarketing Merchants
  7. Multi-level marketing businesses
  8. Rebate-based business and up-sell Unlicensed Multi-level marketing merchants
  9. Telemarketing
  10. Time sharing
  11. Gold bar
  12. Investment scheme
  13. Buyers’ Club / Membership clubs
  14. Key-entry Telecom Merchant providing single local and long-distance phone calls using a central access number in a non–face-to-face environment using key entry
  15. Telecommunication Services including but not limited to prepaid phone services and recurring phone services
  16. File sharing services
  17. Drugs, Drug Proprietors, and Druggists Sundries
  18. Drug Stores, Pharmacies
  19. Internet pharmacies / Internet pharmacy referral site
  20. Cigar Stores and Stands
  21. Tobacco / Cigar / Electronic Cigarette / Nicotine content products
  22. Video Entertainment Rental Stores
  23. Credit Counselling / Credit repair services
  24. Credit repair or debt settlement services, credit transactions or insurance activities
  25. Credit protection / Identity theft protection
  26. Associated with purchases of annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card
  27. Associated with the sale of traveller’s checks or money orders
  28. Check cashing businesses
  29. Currency and forex
  30. Sell counterfeit goods
  31. Selling items / services that relates to transactions involving (a) narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, Eg: Drugparaphernalia, prescription and controlled medicines
  32. Operate business that encourage, promote, facilitate or instruct others to engage in illegal activity, including violence, racial or other forms of intolerance that is discriminatory or the financial exploitation of a crime
  33. Sale of stolen goods including digital and virtual goods,
  34. Tobacco, E-Liquids and E-Cigarettes product/service must be legal to be sold in the area that you are selling from and to the state/country you are selling to. The website must have a disclaimer of item not sellable to buyers below 18 years old. senangPay ONLY allows local transactions under this category of business activity.
  35. Fireworks and hazardous materials
  36. Items encouraging illegal activity
  37. Involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent Suspicious and irregular activities: Criminals, Drug traffickers, Terrorists, Arms dealers
  38. Any attempt of money laundering as a way to fund and expand illegal activities.

Illegal Use And Suspicious Activities

SecurePay has the sole discretion to refuse, impose additional conditions, withhold, reverse, refund and/or suspend any settlements or transactions that we believe (at SecurePay sole discretion and determination):

  1. may violate this Agreement or other agreements you may have with SecurePay;
  2. are unauthorized, fraudulent or illegal;
  3. are deriving from Prohibited Businesses and/or Restricted Businesses under our Appendix of Regulated and Prohibited Nature of Business; and/or
  4. expose SecurePay and/or other parties to risks that SecurePay deems not suitable.

If SecurePay suspects and/or receives a complaint, report, dispute or chargeback request on any unauthorized, fraudulent or illegal transactions from consumers, financial institution, authority and/or law enforcement agency, SecurePay reserves the right to withhold your collection settlement until the case has been closed.

In the event that SecurePay determines there is no other feasible solution to recover the unauthorized, dispute or chargeback amount due to any factors including but not limited to, the merchant being uncontactable, SecurePay reserves the right to offset the unauthorized, dispute or chargeback amount from the withheld collection settlement. The remaining amount will then be paid out to the verified bank account accordingly.

If SecurePay suspects, have reason to believe and/or know that you are using or have used SecurePay Services for unauthorized, fraudulent, or illegal purposes, you give SecurePay consent to share any information related to such activity with the appropriate financial institution, authority, or law enforcement agency. The information may include but is not limited to information about you, your SecurePay Account, your Consumers, and transactions made through your use of SecurePay Services.

If SecurePay is required by the financial institution, authority, or law enforcement agency for any ongoing investigation related to you, SecurePay will fully cooperate with the relevant institution, authority or agency to ensure compliance with all legal and regulatory requirements.

In relation to the above, you agree and shall provide your utmost cooperation in assisting SecurePay by providing the necessary information and/or documentation as required from time to time to assist SecurePay with its determination. However, SecurePay shall have no such obligation to conduct any inspection or investigation.

You shall have no right to claim for any losses or damages in relation or consequential to the above action taken by SecurePay for any transaction. Further thereto, SecurePay shall have the absolute discretion to terminate, suspend, close or limit your SecurePay Account and/or access to SecurePay Services or remove any data or content transmitted via the Platform without liability, and any license created hereunder may be limited by SecurePay.

In the event that the payment information provided by the Buyer does not match the information on record with the Bank or the payment account owner, SecurePay reserves the right to hold the settlement of the transaction until further investigation is conducted. SecurePay may, at their discretion, request additional documentation or clarification from the Buyer to resolve any discrepancies. If the issue cannot be resolved satisfactorily, SecurePay retains the right to refund the payment to the original account from which the funds were received.
