Q. Is California Penal Code 25640 still valid?
A: Yes, California Penal Code Section 25640 is still active and valid law. It has not been repealed, though navigating how it interacts with other complex California gun regulations requires careful attention.
Q. Will jail result from lying about a domestic violence report in California?
A: It is a misdemeanor to provide false information to a police officer. If what you are saying is that you did provide false information then you could be prosecuted if the District Attorneys office decides to bring charges against you. However, it is more likely than the District Attorney or one of their investigators will contact you to speak to you about the incident. They will want to decide if they should prosecute your husband for domestic violence or not. You should be careful in speaking to anyone about this matter without having a lawyer to guide you through this process.
Q. Would paying damages before court help in a felony vandalism case in CA?
A: Definitely it would be a good idea to consider making restitution at the earliest point in time. However, you should work with your lawyer to determine when restitution should be paid. Often the victim in a case will state that the amount they are owed is more than the defendant believes that they owe. It is a good idea to resolve the proper amount of restitution. In this way the victim can tell the prosecutor that they have been "satisfied" and paid back what they are owed. However, this does not mean that the victim will not seek a jail or prison sentence. This is why a very good idea is to have your lawyer reach out the allege victim prior to you paying restitution to see what their
