CometAPI Terms of Service

Welcome to CometAPI (hereinafter referred to as the “Service”). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Service.

1. Service Content

CometAPI provides an AI model aggregation platform that enables users to access various artificial intelligence models, including but not limited to:

  • Text generation
  • Text-to-image generation
  • Image analysis
  • Audio and video processing

2. User Accounts

2.1 Registration Requirements

You must provide true, accurate, and complete information when registering an account, including but not limited to your email address and other required details.

2.2 Account Security

You are solely responsible for safeguarding your account credentials and API Keys.
If you believe your account or API Key has been compromised, you must notify us immediately and take appropriate measures to secure your account.

2.3 Usage Restrictions

You may not use your account for any unlawful, fraudulent, or abusive activities, including but not limited to intellectual property infringement or violations of applicable laws.

3. Usage Rules

3.1 API Usage

You must use the Service strictly in accordance with the official API documentation and must not abuse, overload, or attempt to circumvent usage limits or safeguards.

3.2 Data Storage and Privacy

  • CometAPI does not collect or store user prompts, inputs, or model outputs.
  • We may collect limited technical logs (such as IP addresses, timestamps, and request frequency) solely for security, compliance, and service optimization purposes.

3.3 Fees and Billing

  • Certain features of the Service require payment. Pricing details are available on our official pricing page.
  • Promotional discounts or recharge offers may be provided from time to time and are subject to separate terms or announcements.

3.4 Credits, Auto-Reload, and Refund Policy

(a) Prepaid Credits and Usage-Based Fees
Certain features of the Service operate on a prepaid, usage-based billing model. To access such features, you may be required to purchase prepaid credits (“Credits”) in advance. Credits will be deducted from your account balance based on actual usage of the Services, including API calls, compute time, or model outputs.
Credits:

  • do not constitute personal property;
  • are not redeemable for cash and have no cash equivalent value;
  • are non-transferable and may only be used in connection with the Services.

(b) Auto-Reload of Credits (Stripe)
You may enable an automatic credit reload feature (“Auto-Reload”) through your account.
By enabling Auto-Reload, you authorize CometAPI and its payment processor (including Stripe) to automatically charge your selected payment method when your credit balance falls below a specified threshold or based on other settings you configure.
You are responsible for maintaining valid payment information.
CometAPI is not responsible for any service interruption or failure caused by declined payments, payment processor errors, or disabled Auto-Reload settings.

(c) No Expiration of Credits
Purchased Credits do not expire, provided that your account remains in good standing and is not suspended or terminated in accordance with these Terms.
CometAPI reserves the right to revoke or adjust Credits in cases of fraud, abuse, technical error, or violation of these Terms.

(d) Refund Policy for Credits
Credits are generally non-refundable once used or consumed.
However, unused Credits may be eligible for a refund upon review and approval by CometAPI, subject to the following conditions:

  • the refund request must be submitted in writing to support@cometapi.com;
  • the Credits requested for refund must remain unused at the time of review;
  • CometAPI reserves the sole discretion to approve or reject refund requests after internal review, including for risk control, fraud prevention, or compliance reasons.

Approved refunds will be issued using the original payment method where possible.

(e) No Refunds for Consumed Services
Fees for Services that have already been used or consumed, including deducted Credits, API usage, or compute time, are non-refundable.

(f) Billing Errors and Disputes
If you believe you have been charged in error, you must notify us at support@cometapi.com within 30 days of the charge date.
Failure to raise a dispute within this period constitutes acceptance of the charge to the fullest extent permitted by law.

(g) Payment Processing Fees
Payments are processed by third-party payment providers.
Any refunds approved by CometAPI may exclude non-refundable processing fees charged by payment processors, banks, or intermediaries.

(h) Suspension for Insufficient Balance or Non-Payment
If your Credit balance is insufficient or payment fails, CometAPI may suspend or limit access to the Services until payment is successfully completed or sufficient Credits are restored.

4. Legal Compliance

Users must comply with all applicable international laws and the laws and regulations of their country/region when using the Service.
Any liability, loss, or penalty arising from your violation of applicable laws shall be borne solely by you. CometAPI shall not be responsible for such violations.

5. Prohibited Conduct

You agree not to engage in any of the following activities:

  • Attacking, disrupting, or attempting to gain unauthorized access to systems or networks
  • Using the Service for any illegal or prohibited purposes
  • Illegally obtaining, sharing, or tampering with API Keys
  • Reselling, sublicensing, or redistributing the Service without prior written authorization

We reserve the right to suspend or terminate accounts that violate these rules.

6. Changes to These Terms

We may update these Terms of Service from time to time.
Any changes will be posted on this page, and the updated terms will become effective upon publication.
Your continued use of the Service after such changes constitutes your acceptance of the revised terms.

7. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
