00:00The High Court has upheld a 1 million ringgit compensation award in favor of a manager ruling

00:05he was wrongfully dismissed from a family-run company after challenging his late father's

00:11Justice Hayatul Akmal Abdul Aziz said, Wong forklift higher-end services in Riyan Berhad

00:16failed to meet legal requirements for judicial review and did not dispute the facts or relationships

00:21involved.

00:22Hayatul Sid Industrial Court Chairman Deepar Malingam did not err in finding that Wong

00:26Junquiat had been constructively dismissed from the company.

00:30She said the company had arbitrarily reduced Wong's salary, failed to pay wages for February

00:34and March 2019, and did not remit EPF or Percaso contributions.

00:39Hayatul added that Wong was given no work without justification, which he took as being put in

00:43cold storage.

00:45She said Wong was entitled to walk out of his employment, having met all the criteria under

00:49the contract test to establish a constructive dismissal.

00:53In his award, Paramalingam found that Wong's stepmother, Sim Fu Yok, had unilaterally slashed

00:58his salary from RM27,500 to RM6,000 as retaliation for Wong challenging his father's will.

01:05Wong was awarded RM550,000 in compensation, RM660,000 in back wages, subject to a deduction

01:12of RM198,000 on account of post-dismissal earnings, and RM6,000 in costs, though the company

01:18has since filed an appeal against the decision.
