24:18The minimum punishment for a first-time drink driving offence
24:21is a 12-month ban and a fine of up to £5,000.
24:26Some drivers face six months in prison and all will have a criminal record.
24:36Dealing with the amount of drink drivers that we do and the way that people behave,
24:39every now and again, you'll get somebody who still doesn't think they've done anything wrong.
24:44And to be honest, it's infuriating.
24:46Or you'll get somebody who's then going to burst into tears and, you know,
24:49it's the worst tissue in life and that's the point it dawns on them.

26:19and I dare say, as thought, I'll risk it. The limits will affect you differently depending
26:25on what you've had to drink, what you've had to eat that day, generally how you're feeling yourself.

26:48To ensure drink drivers don't get behind the wheel again while under the influence,
26:56police kick them in custody until their alcohol levels are back within normal range.

27:06a real impact on the start of her life and potentially her career options going forward.

32:33to make sure we take those people off the road,
32:36and that could be putting ourselves at risk,
32:38actually getting hold of that person,
32:39getting them out of vehicle.
32:40It's a dangerous game that we play sometimes,
32:43but we still have to do our job.

32:49and you've told me that you've had a drink,
32:50so therefore I've had the suspicion,
32:52I've already given you the requirement
32:53which you've said you're going to provide,

33:27and admitting to taking the car without consent,
33:29the man doesn't have a current driver's licence,
33:33and he's not insured to drive this car.

37:41and the machine now and in custody
37:43is a much more accurate and evidential machine.
37:46There's always that question of
37:47are they going to be under when we get to the custody suite?
37:50Because every moment,
37:51you're dropping that alcohol out of your system.
37:53I've witnessed driving on the road.
37:55He got a couple of lights out of the vehicle
37:57so I've stopped it.
37:57He's admitted to have been drinking four cans of Stella
38:00prior to driving
38:01and also that he'd swapped
38:04the vehicle from his cousin
38:05so we've got to make those inquiries
38:08however at the moment he's been arrested.
38:09What we're going to do,
38:10we're going to do an evidential breath test
38:11then you're going to get better down.
38:12Can you get some clothes?
38:13Yeah, they'll sort you out.
38:14Get some dry ones.
38:15Okay, so I require you to provide me
38:18two specimens of breath for analysis
38:21by means of an approved device.

39:46so it'll take about five minutes,

39:48we'll get you some snap,
39:49we'll get you a drink,
39:50and then you can get your head down for a bit.

40:11and then you're going to be charged with the drink driving element.

40:17This chap's been very up and down.
40:19He's continued to be quite difficult in custody,
40:21but eventually he's been happy to provide two samples of breath in the evidential machine.
40:27And he's blown below an evidential reading of 69,
40:30which is twice the legal limit.
40:31So he'll have to be interviewed in the morning about the twat element,
40:34if we can actually establish that's happened.
40:36And I don't doubt that he's been living in that car for the last couple of days, drinking,
40:40and I'm sure he's probably been driving around absolutely hammered as he was tonight.
40:44We'll see what we get in the morning,
40:45but realistically, he's getting charged, he's going to get disqualified,
40:48so it's a good result.
41:01After four hours in a cell,
41:03Matt Cork's 18-year-old drink driver is sober enough to be charged.
41:09You don't have to say anything, but it may harm your defence.
41:11If you don't have to mention now something which you'll later align in court,
41:14anything you do say may be given in evidence, OK?
41:17So I'm going to give you a bail.
41:18You need to go to Chesterfield Magistrates Court and answer your bail, OK?

41:38Last year, Derbyshire police prosecuted more than 1,200 drink drivers
41:52and attended over 70 collisions where alcohol was involved.
41:56At no point has ever crossed my mind to think, having had a few pints,
42:01I'll, you know, forget the taxi, forget the five-minute walk,
42:04I'll just take my car, I'll risk it.
42:06The freedom that you get being able to drive, it's not a given right,
42:09it's a privilege at the end of the day.
42:11So why am I going to put my driving licence in jeopardy by taking that risk of getting behind
42:17the wheel after I've had a few drinks?
42:19I'm a driver on a road, my partner's a driver on a road, we drive around with our kids in
42:26the car, as friends in the car and it could be us that's been hit by a drink driver and
42:32it does scare the life out of me.
42:33Realistically, if you're going to have a drink, just don't drive and if you plan on driving,
42:38don't have a drink.
42:40A lot of fatalities and serious injuries do come from drink and drug drivers becoming more
42:45prevalent again.
42:46It's very frustrating for us because if you need a lift somewhere, you can either ring
42:49somebody to come and get you or you can get a taxi or you can get a bus or you can walk.
42:54It just shows a blatant disregard for other people.
42:57If you're a drink driver, you've got to be lucky every time.
42:59We just need to be lucky once.
43:00In this episode, the suspected drink driver who left the scene of a collision with a motorbike
43:11was convicted for failing to provide.
43:21He was disqualified from driving for three years and given a six-month community order
43:27to complete rehabilitation and alcohol treatment.
43:34The 18-year-old driver, who was under the influence...

43:45...was sentenced to a 17-month disqualification, reduced by 17 weeks if she completes a drink driver
43:53safety course.
43:54Arrested on suspicion of driving whatsoever, prescribed alcohol after being stopped driving

44:00She's provided a sample of 77.
44:03She was also fined and ordered to pay court costs.
