2·6 days agoProps to you, homie. I didn’t personally know about your instance, so your character is courageous and exemplary. I’d like to think my values are aligned with yours as I’ll stand up for trans people, too.
While the likelihood of being served a subpoena to turn over your data is slim, just be careful. Remember - even if someone else wrote it, it’s YOUR data. If you already don’t have a great moderation team on your server, make sure to set ground rules and stamp out calls to violence and other things that would get someone in loads of trouble. The state won’t target an online community, but persons making active threats to the state (e.g., a call for assassination of a public figure, organising violence and harm, etc.) will get you in loads of trouble.
If I was on your server and some dipshit was threatening assassinating a politician or organising a hit, you got served a subpoena, and you were getting ready to delete your instance, I’d jump in and request you to stop. I don’t think it’d be worth nuking the whole community and all the data so you get punished on behalf of that one dipshit. Don’t think it’d be worth having your life destroyed because one edgelord thinks it’s great to say stuff like that online without reprisal, in our state-sponsored surveillance system.

Edit 2: On turning over data. In the discovery phase of litigation, they’re legally obligated to cull the request for information to what is relevant and in-scope. In my above example, the courts want the IP address and other identifiers of the dipshit that called for the assassination of a public figure. You’d only have to turn over the data for that one person, NOT everyone on your server. Just to put the facts out there.

4·6 days agoIf you’re subpoenaed and a request for discovery is not met because you destroyed evidence, that comes with severe penalties. In court, you’d have to prove that you didn’t intentionally destroy data. You’ll have to find an attorney that can protect you against a government or powerful corporation.
Depending on the country and jurisdiction, intentional spoliation of data will lead to harsh penalties, criminal charges, expensive financial restitution, and jail time. Would you want to serve multiple years in jail and pay tens of thousands (or much more) in fines just to protect the data on your server? Would you want criminal charges and job loss, and the incredible difficulty of finding employment again when you get out of jail? Permanent criminal charges on your record for the rest of your life?
If yes, you’re very, very brave. Most other server owners would just comply. They’re already struggling to pay their bills, including serving Lemmy. Must be expensive trying to get legal representation when they’re ordered to turn over data.

- If you factory reset your device, it will not work. Literally, this is what Amazon said. You will not be able to use your device if you ever need to factory reset it.
- The only thing you can do is read the books you already downloaded.
It’s perfectly fine to no longer make updates for legacy hardware. But to prevent users from downloading the books they paid for is absurd. Ebooks are just fancy packaged HTML files. No reason Amazon should prevent you from downloading them.
The average consumer is screwed and will buy a new device. The more technical users will just jailbreak it. Regardless, this will create lots of ewaste as the average consumer is far from technical.

And also, we ended the Iran war that they started! Look what they made us do to them! And we got— uh… what did we get again for winning? Anyway, we won and the straight thingie, the thing that we need to open? Hormel reopened (and they’re great by the way), where we put the oil is now ready to oil for us less price gas for all Americans now hence. Sounds to me like you haven’t played any of the new Nintendo first-party games that are highly revered. Tears of the Kingdom as an example, is a gut-wrenching and dramatic game. I prefer the older Zelda games (having grown up on them starting with SNES), but I would be laughably naive to deny that the latest two Zelda’s have been ground breaking, or claim that they’re “made for people who never played a video game/lowest common denominator”. Mario Odyssey is charming and fun, and one of the best platformers I played (top title goes to Astro Bot on PS5 for me). The Xenoblade games are top tier. DK Bananza is endearing, touching, and incredibly fun. Pokopia, I already commented above - one of the best Pokémon games to have come out (given that GameFreak churns out games so quickly and refuse to innovate). Pokopia was developed by someone else, and boy does that game put the other mainline Pokémon games to shame. Lots of other examples, but I’m tired of typing on mobile.
Edit: I still love Nintendo first party games, but I’m a gamer. I play primarily PC, Nintendo, and then PS5 and Xbox Series for the occasional first party game I can’t get anywhere else - like Astro Bot. I regret the Xbox but man do I love Astro Bot on PS5 - best platformer I’ve ever played (for gameplay, not story).

102·9 days agoI disagree on the smooth brained comment. Nintendo first party games (the reason to buy their consoles) are always top-notch.
The ones I’ve bought on Switch 2:
- Mario Kart World - wonderful game with excellent driving mechanics. Open world and lots of fun.
- DK Bananza - endearing game with a heartfelt story, great music, fun gameplay. Really enjoyed my time 100%ing this game.
- pokemon Legends Z-A: good game overall. Nothing groundbreaking but fun.
- Pokemon Pokopia - I’m absolutely obsessed. Heartfelt story, hits so many nostalgic beats, tackles a difficult subject of humans destroying the environment. What happens to our Pokes when we humans have to leave them behind? Amazing game with deep breadth, excellent quality of life that builds upon typical sandbox games, and the music is so nice. When I first heard the Pokémon healing melody adapted into one song, or when I reached a destroyed Palette Town and heard all the original Pokémon Red/Blue musical beats embedded in the overarching musical theme, I was so moved. Very touching game, too. One of the best Pokémon spin offs I’ve played, and this game is canon.
Still waiting on more first-party games that are on the horizon - the potential Ocarina of Time remake if the rumors are true, Pokémon Winds/Waves, and the new 3D Mario game.
Any other game I haven’t picked up because I would rather play it on PC.

9·1 month agoHere is what I do: Host your friends at your place for sports, grilling, video games, playing touch football or soccer in your backyard, etc. Much better activities, make memories, and a lot cheaper, more intimate, and better for everyone’s relationship.
