Tracking who is inventing what at a competitor can tell you a great deal about where their technical talent is focused. There is, however, a flip side. Everything above applies equally to your own filings. Your patent applications are just as visible to your competitors as theirs are to you. This creates a strategic question that every growing company should be asking: for each innovation, is a patent — with its mandatory public disclosure — the right form of protection, or would a trade secret serve you better? That question has no universal answer.
