Three major developments in the last week should have every HR leader, employer, and AI vendor paying attention: 1. The AI Civil Rights Act was reintroduced in the US Congress Led by Senator Ed Markey and Representative Yvette D. Clarke, this legislation places hard guardrails around AI and algorithmic systems used in decisions related to hiring, housing, healthcare and beyond. It demands transparency, bias testing, and accountability. Think of it as GDPR for bias, but with broader implications across HR, tech, and operations. “We will not allow AI to stand for Accelerating Injustice.” – Senator Ed Markey for U.S. Senate 2. California’s new workplace AI discrimination laws are now in effect. The new rule governing companies' use of automated decision-making technology will likely create a situation where companies are liable for hiring practices if a system violates anti-discrimination laws. As other U.S. states also implement laws and regulations containing similar ADMT protections, companies deploying the technology will need to be proactive in their record keeping and vetting of third-parties while auditing their own tools to understand how the software functions. It’s no longer enough to trust your tools and vendors, you must prove they’re fair. 3. Insurers are backing away from covering AI risks AIG, Great American, and WR Berkley are asking regulators to exclude AI-related liabilities from their policies. Why? Because the risks (from chatbots hallucinating to algorithmic bias in hiring) are seen as “too opaque, too unpredictable.” When insurers are pulling cover, it’s a warning sign: you own the risk. 👁 What this means for HR and recruitment business leaders: We’ve officially entered the age of AI Accountability. That means: ✅ You need visibility into how your AI systems work, especially if they’re used for hiring, performance management, or workforce planning. ✅ You must audit your HR tech stack (yes, that includes Workday, ATS platforms, and even AI resume screeners). ✅ You need to document fairness, not just assume it. ✅ You must rethink your contracts with AI vendors. Here’s why: Paola Cecchi-Dimeglio, a Harvard lawyer and Fortune 500 advisor, has a warning for HR: If you ignore AI bias, you scale discrimination because it learns our prejudice and amplifies it in hiring and performance decisions. I grew up watching machines go rogue🤖 Now I help companies stop that from happening in real life. 🦾 Growing up, I loved watching sci-fi movies. In the 90s, the theme was always the same: man creates a scientific marvel, man loses control over said marvel… cue the running, screaming, and inevitable bloodshed. As a kid, I lapped up those stories, which always hammered home one moral: humans messing with the laws of nature never ends well. Fast forward to today, and I find myself advising companies on a very real version of that narrative, which is using AI in HR. With AI tools increasingly used to monitor performance and even flag employees for dismissal, the question isn’t just “can we do this?” but “should we? And how do we do it fairly?”. I recently shared my views on this topic with HRD Asia (link to article in the comments below). In general, HR teams must get the following right: 🔹 Transparency: Employees should know how their performance is being assessed and what data is being used. 🔹 Human Oversight: AI should assist human judgment. It can never replace it. Accordingly, a meaningful review process is essential. 🔹 Vendor Accountability: Employers must understand how third-party tools work and ensure they don’t produce biased outcomes. 🔹 Appeal Mechanisms: Employees need a way to challenge decisions influenced by AI. 👨⚖️ In my practice, I’ve already seen clients ask whether an AI-generated score is enough to justify dismissal. My answer? Not without human validation and a clear explanation of how the score was derived. Implementing a Human-In-The-Loop approach to any automated scoring tools would also ensure that any employment decision is validated by an employee who can justify the AI-generated recommendation. This is especially important in employment decisions relating to summary dismissal which carry significant legal risks, such as wrongful dismissal claims. While there is no hard and fast rule when it comes to determining the appropriate level of intervention, the key principle is that the reviewer must be able to understand how the AI arrived at its decision and the individual must have the authority to override it if necessary. The review process should not be a mere formality or rubber-stamping exercise; it must serve as a meaningful check to ensure fairness and accountability. As the use of AI tools in HR is increasingly becoming popular, the time to get familiar with the legal issues surrounding its use is now. Build internal safeguards, update your policies, and make sure your HR team understands the tools they’re using. Because if those 90s sci-fi movies have taught us anything, it’s that leaving machines to make human decisions rarely ends well. This is HUGE. A federal judge just allowed a collective action lawsuit to proceed against Workday, claiming its AI-driven hiring tools discriminated against older applicants. This has huge implications. This case could define how - and if - AI can be used fairly in hiring. To quickly recap the case: 👉 Derek Mobley, a Black man over 40 with anxiety and depression, says he applied to 100+ jobs via Workday-powered systems over several years - and was rejected every single time. 👉 Workday’s tools include algorithmic personality and cognitive assessments that screen and rank applicants. As someone building AI into hiring, I believe this moment is pivotal. Algorithms trained on historical data often mirror historical biases. If left unchecked, they become gatekeepers to exclusion - especially for career breakers, older workers, or those with non-traditional paths. And agentic AI compounds this disadvantage even more. At ivee | The return-to-work platform, we use AI differently: to remove bias, not reinforce it. Our models are trained on the dataset of returners, ensuring we surface talent that other systems miss. If you work in Talent Acquisition, what can you do about this? To save yourself a court case down the line, I'd recommend 6 key steps: 1️⃣ Audit your vendors Demand transparency. Ask how their systems are tested for bias - and require contractual safeguards against discrimination. Ask them what dataset their models are trained on, and if this is representative (it probably won't be). 2️⃣ Retain human oversight Don’t let machines make final calls. Train your TA teams to review and override rankings when necessary. Take sample datasets and ensure you agree with the algorithm ranking - and track this somewhere! 3️⃣ Document criteria and justifications Avoid vague “fit scores.” Ensure every hiring decision is traceable and explainable. 4️⃣ Monitor for disparate impact Regularly analyse outcomes across age, race, and gender. Treat significant disparities as urgent signals - not statistical footnotes. 5️⃣ Build AI governance now If you haven’t yet created a governance framework for AI in hiring, now’s the time. Future-proof your organisation by setting ethical guardrails early. 6️⃣ Track legal developments Regulatory frameworks are evolving - but the courts will likely lead the way. Stay informed - I have set up Google News Alerts for key cases and headlines which is really helpful. 7️⃣ Partner with ethical recruitment tech companies Make sure you are casting an ethically wide net. The European Commission published 140-pages of AI guidelines. Here's how it impacts HR teams. ❌ No longer allowed (but were you really doing these?) Emotion Recognition – AI tools that infer stress levels, engagement, or emotions at work are banned (except for medical/safety reasons). Social Scoring – AI can’t rank or classify employees based on workplace behaviour or personal characteristics. Biometric Profiling – AI cannot categorise people based on traits like race, religion, political views, or sexual orientation. AI That Predicts Employee Risk – Any AI assessing the likelihood of misconduct or performance issues based solely on profiling is illegal. --- ⚠️ High-risk AI in HR (strict compliance needed) AI used in hiring, promotions, and performance management—meaning it must meet strict transparency, fairness, and oversight requirements. AI must not be a black box—employers need clear documentation on how decisions are made. Any automated hiring or evaluation system must undergo risk assessments before deployment. --- 🔍 What HR teams should do now 1️⃣ Review AI in your HR tech stack If your tools AI, check what data they process and how they rank employees. Employees using AI at work will be the workplace issue of 2026. Not remote work. Not noncompetes. Not DEI. AI. Because employees are already using it — to draft emails, summarize documents, create work product, prepare presentations, and even help with performance reviews — whether employers have approved it or not. And most companies are completely unprepared. If your organization doesn't have a workplace AI policy, you don't have an AI strategy — you have an unmanaged risk. Every business, regardless of size or industry, should have a clear, practical AI "Responsible and Approved Use" policy that covers at least these 10 essentials: 1.) Approved vs. prohibited AI tools Identify which AI tools employees may and may not use for company business, and establish a process for reviewing and approving new AI technologies as they emerge. 2.) Confidentiality and data protection Prohibit employees from inputting confidential, proprietary, personal, or client information into AI systems and from training AI models on company data without express authorization. 3.) Accuracy and human responsibility Require human review of all AI-generated content and confirm that employees—not AI tools—remain fully responsible for the accuracy, quality, and compliance of their work. 4.) Bias and discrimination safeguards Prohibit the use of AI in ways that create or perpetuate bias, particularly in hiring, promotion, performance evaluation, discipline, or termination decisions. 5.) Intellectual property ownership and protection Clarify that AI-generated work created in the scope of employment is company property and must not infringe third-party intellectual property rights. 6.) Legal and regulatory compliance Require all AI use to comply with applicable laws and regulations, including those governing discrimination, wage-and-hour, privacy, data protection, and intellectual property. 7.) Transparency and disclosure expectations Define when employees must disclose AI use internally and when disclosure is required in communications with customers, clients, regulators, or the public. 8.) Limits on employment-related decisions Prohibit fully automated employment decisions and require meaningful human involvement in any AI-assisted hiring or other employment-related decisions. 9.) Security, IT, and cybersecurity alignment Require AI use to comply with IT and cybersecurity standards and prohibit the use of unapproved or personal AI tools for company business. 10.) Training, enforcement, and accountability Require periodic training on appropriate AI use and provide that violations of the AI policy may result in discipline, consistent with existing company policies and procedures. None of this about being anti-AI. It's about being intentional, lawful, and smart. Like it or not, AI is here to stay. Now is the time to get ahead of it. Does your business have an AI policy? The first comprehensive law in the U.S. to regulate AI was signed this month in Colorado. It comes into effect in February 2026 and regulates artificial intelligence (AI) systems that make decisions that have a consequential impact, such as in employment, health care, essential government services, housing, and financial services (defined as high-risk AI systems under the act). The act sets forth stringent requirements for both developers (i.e., any person or entity that develops or intentionally and substantially modifies an AI system) and deployers (i.e., any person or entity that uses a high-risk AI system) and is intended to promote transparency and protect Colorado residents from algorithmic discrimination. Key provisions include: · Algorithmic Discrimination Prevention: Developers and deployers must use reasonable care to prevent discrimination based on age, color, disability, ethnicity, genetic information, language proficiency, national origin, race, religion, reproductive health, sex, veteran status, or other protected classifications. · Documentation and Transparency: Developers are required to provide detailed documentation, including the purpose, intended benefits, and known risks of AI systems, to ensure deployers can conduct thorough impact assessments. Both developers and deployers must publicly disclose the types of high-risk AI systems they work with and how they manage potential risks. · Consumer Notifications: Deployers must notify consumers when a high-risk AI system is being used to make consequential decisions affecting them. Such notice must provide clear information about the AI system and the decision-making process. In cases of adverse decisions, consumers must be given the opportunity to correct inaccurate data and appeal decisions involving human review. · Enforcement and Compliance: The Colorado Attorney General holds exclusive enforcement authority. Compliance with nationally or internationally recognized AI risk management frameworks can serve as a defense against enforcement actions. The law could impact a number of organizations that are developing or deploying AI systems that use geospatial information. Examples of geospatial AI (GeoAI) applications that could be considered high risk under the Colorado law include: · Real Estate Valuation: AI systems estimating property values based on location data might inadvertently incorporate biases, affecting loan approvals and housing opportunities. · Health care access: AI-driven analysis of geospatial data for health care services could prioritize resources inequitably if not carefully designed and monitored. · Predictive Policing: Using AI to analyze geospatial data to predict crime hotspots could lead to over-policing in certain neighborhoods, disproportionately affecting minority communities. #geoai #geoint #geospatiallaw

You’re working in People Ops at a mid-size tech company. You just rolled out a new AI-based performance review platform. It uses sentiment analysis, peer feedback, and productivity scores to help managers assess employee performance more “objectively.” But things take a turn. An employee files a complaint claiming the AI-generated feedback was biased and possibly discriminatory. They say the model flagged their performance inaccurately and they’re concerned it may be tied to race or gender. Your legal team is now involved, and leadership wants your help ensuring this doesn’t spiral. What’s your next move? First things guess, you’d freeze any further use of the AI review tool until an internal risk evaluation is done. Document the complaint, notify legal and your AI governance contact, and request logs or metadata from the tool to trace how the score was generated. Then, review the procurement and onboarding process of that AI tool. Was there a bias assessment done before rollout? Was HR trained on interpreting its outputs? If not, that’s a major gap in both governance and operational risk. Next, conduct a bias audit — either internally or with a third-party — to validate whether the tool is producing disparate impacts across protected groups. At the same time, inform your DPO (if applicable) to check if any personal or sensitive data was used beyond its intended scope. Lastly, you’d update internal policy: new tools affecting employment decisions must go through risk reviews, model documentation must be clear, and a human must always make final decisions with audit trails showing how they arrived there. #GRC
