Immigration Practitioners, You Have to Read This If you haven’t fully dug into the USCIS policy changes that took effect on January 1, 2026, you’re going to be blindsided by what I’m about to describe. I’ve had too many clients come to me after being told inaccurate information from other attorneys on this very issue. On January 1, 2026, USCIS issued a new policy memorandum directing officers to place an adjudicative hold on all pending immigration benefit applications filed by or on behalf of individuals connected to designated “high-risk” countries. This isn’t limited to certain forms or categories. It applies broadly to all benefit applications filed with USCIS. That means cases involving adjustment of status, work authorization, Naturalization (N-400) and I-129/I-130/I-140 petitions are all subject to this hold and enhanced review (with small exceptions listed in the memo) Here’s the first thing you have to know. The memo doesn’t carve out a safe lane for any specific type of application. It doesn’t say that work permits or immigrant petitions are exempt. Instead, USCIS officers are now instructed to continue internal processing, background checks, RFEs, and interviews, but final adjudication is paused for affected cases until further policy guidance or unless a specific exception applies. That means if your client is from one of these countries, you need to be honest with them before they file anything. Yes, you can submit the case and receive a receipt notice; internal processing may continue. But no one can predict when, or even if, USCIS will make a final decision while this hold remains in place. The memo makes that clear. Second, and this is critical, the restrictions are based on the countries listed in Presidential Proclamation 10998, which expanded the earlier travel-ban list to include many more nations designated as “high risk.” Nationals of these countries, defined by citizenship, birth country, or certain travel documents, are subject to the new processing hold. That group includes many countries you see regularly in practice: Venezuela, Nigeria, Iran, Haiti, Syria, Sudan, and many others. But it also includes a wider range of countries beyond the classic “travel ban list.” What this means for your practice is simple but profound: Before you file an I-485, I-765, I-130, I-129, I-140, N-400, or just about any other benefit application with USCIS for a client tied to one of these countries, you must inform them that USCIS may not issue a final adjudication anytime soon. You need to prepare them for delays, enhanced vetting, and the possibility that routine processes like work permits, status changes, and travel documents may be stalled. And you need to communicate that these delays are not case-specific problems. They are the product of published agency policy.

EASA - European Union Aviation Safety Agency has just published the updated European Plan for Aviation Safety (EPAS). It’s a biiiiiiig document... Hundreds of pages... Quite easy to scroll through... And even easier to miss what really matters. But... if you read between the lines, EPAS is not just about safety targets or regulatory housekeeping as such, it’s a statement about how we want aviation to evolve. And that sounds good, right? One thing I noticed in this updated edition: the explicit recognition that “one-size-fits-all” regulation does NOT always serve safety! For the first time this clearly, EPAS acknowledges that business aviation sits in a complex space, between airline-like operations and highly specific, often innovative business models, and that pushing smaller CAT or NCC operators into a regulatory box designed for large airlines can actually have unintended safety consequences. That is an uncomfortable truth, but a necessary one! Proportionate rules are NOT about lowering standards, they are about aligning requirements with reality... About keeping operators inside a framework that makes sense, instead of forcing them to step outside it (which is a major Safety Issue as well!). EPAS also reinforces something I deeply believe in: safety is no longer just about compliance. It’s about resilience, human performance, mental health, competence, and the ability of organisations to adapt in a world that keeps changing faster than our rules. This plan opens doors.
